Bundeswehr ISAF-deployment in Afghanistan

The diploma thesis deals with deployment of German army within ISAF strategy in Afghanistan. The deployment of military forces is one of the most discussed queries in German politics and among German public. The thesis analyses the development in Afghanistan from 2001 to September 2013. The thesis is divided into three parts. Firstly, I define the theory of role and the concept of civil power, which is one of approaches for analysis of foreign policy. I define some criteria and according to them I examine, if Germany behaves in Afghanistan as civil power, for which is it considered. In the following part I deal with the development in Afghanistan from 2001 to 2009. I analyse the beginning of OEF and ISAF operations, mandate's extensions, the reasons for deployment in Afghanistan and the development of the security situation in country. The main part of this thesis is the deployment of German army within new ISAF strategy in Afghanistan, which was declared by American president Barack Obama in 2009. Collective Actions of the UN Security Council for Protection of Human Rights

This thesis Collective Actions of the UN Security Council for the Protection of Human Rights deals with, as the title suggests, collective actions for the protection of human rights with the mandate of the UN Security Council. The thesis is divided into an introduction, conclusion, and four chapters. In the first chapter, the system of human rights protection is described, as it was set up within the newly-formed United Nations after World War II. This chapter also deals with collective actions of the UN Security Council, with or without the use of force, on a theoretical level, e.g. their authorization and possibility of measures that can be taken within the UN system against the perpetrator. Second chapter deals with examples of collective actions of the UN Security Council during the Cold War period. In this era, collective actions of the UN Security Council were authorized only twice, in case of South Africa as a reaction to their policy of apartheid, and in case of South Rhodesia as a reaction to the unilateral declaration of independence by the white minority government. Intervention to protect a country's own nationals from the perspective of international law

The concern of this thesis is the intervention to protect nationals from the perspective of international law, which is part of a broader issue of the use of force in international relations. Although this type of intervention was already a part of the international community before the Napoleonic era - even in the 20th century it was not a minor feature - it is still controversial, and subject to many different interpretations. There are not only big differences between the opinions of particular states of the international system, but also among the international law scholars. The main goal of this Master's thesis is to answer the research question: Is the intervention to protect nationals legal according to the rules of international public law? Besides the Introduction and Conclusion this thesis is divided into four chapters. The first is devoted to the definition of the given phenomenon. It is an integral part of my thesis, because there is no legal definition of the term intervention to protect nationals or of the term intervention. The second chapter deals with the rules of use of force within international relations - above all with Article 2(4) of the UN Charter (which prohibits the use of force) and its exceptions. Analysing the alternation of strategic subcultures: the case of Israel

The thesis examines altering of Israeli strategic subcultures and their influence on strategic decision-making. It expands the body of literature on strategic culture. The strategic culture influences the decisions regarding when, if and how to use force. The three cases in this thesis encompass strategic decision-making in regard to Iran, Hezbollah and the Syrian civil war. The strategic culture takes a form of particular strategic subculture, which expresses a preference for a particular kind of strategic behaviour. Israeli strategic culture is examined thoroughly throughout its history in the context of strategic culture. The strategic culture and its aspects are described on the background of evolving "national security doctrine." The changes in the strategic culture are correlated with the shifts in the strategic environment and with the evolution of new military technologies and strategies of waging war.

UN Peacekeeping in the Early 1990s: Evaluation of the outcomes of second-generation operations with Chapter VII mandates

This Master's Thesis is devoted to the United Nations peacekeeping, particularly second- generation operations in the early 1990s and their evaluation. The aim of the thesis is to evaluate the (lack of) success of the selected missions, which were the first examples of operations authorized under Chapter VII of the Charter of the United Nations. The theoretical part focuses on the concept of peacekeeping itself, historical development, types of peace operations and literature review, as there are various criteria on how to evaluate peacekeeping missions. For the purpose of this thesis, the work examines three peace operations - the United Nations Protection Force (UNPROFOR), the United Nations Missions in Somalia (UNOSOM I and UNOSOM II) and the United Nations Observer Mission in Liberia (UNOMIL). The case studies provide a brief overview of the conflict, the main roots of the conflict, a response from the international community, deployment of the mission and its evaluation according to the selected framework. Furthermore, the supplementary discussion regarding the development and situation in the country in the aftermath of the mission's withdrawal enriches the case study. The Legality of the Use of Force against Islamic State

The aim of this thesis is to evaluate the lawfulness of the use of force by the United States of America against the so-called Islamic State in the territory of Syria, in terms of Ius ad bellum. For this purpose, the thesis is divided into three parts. The first part focuses on assessing the subjectivity of the Islamic State. In particular, the subjectivity is examined with regard to the criteria arising from the Montevideo Convention on the Rights and Duties of States and from professional experience. The Islamic State is assessed in terms of defined territory, permanent population, effective government, capacity to enter into relations with other states, independence and legitimacy. The second part deals with the legal regulation of the use of force in international relations. After the presentation of the historical development, the attention is paid especially to the UN Charter and the ensuing prohibition of the threat or use of force in international relations. In the context of the use of force against the Islamic State, legal exceptions to this prohibition, which could be used in the fight against the Islamic State, are presented.
